The Lies I Heard From My Credit Card Debt Collectors in the Philippines

One reason why you're here is maybe because you're experiencing threats or harassment from credit card debt collectors here in the Philippines. Be placid, just don't believe them. Because all you'll hear from them are big lies.
- I am a filipino credit card defaulter

I am a filipino credit card defaulter
For whatever valid reasons I have that I wasn't able to pay some of my credit cards here in the Philippines, I know it was all my fault. I am guilty that I stopped paying my credit cards but I should move on with my happy life.
Yes, it came to a point that I feel too worried about these unpaid credit cards, why? That is because of these credit card debt collectors who never fail to call me, harass me, insult me, give some threats, yell at me and what not. They will do everything just to make me feel desperate to pay them. Yes I feel scared at some point in my life...paranoid maybe.
Until one time I dropped by a blog where I found people with the same situation like mine. The blog gives some guidelines on credit card paranoia. Reading the whole content of that blog is maybe a sign from God telling me to stay calm and I must not be afraid.
To cut the story short, I learned that all the things I heard from my credit card debt collectors here in the Philippines are all lies.
If you are experiencing the same things like mine, here are the words you can hear from them too...that you shouldn't believe.
The piece of paper saying they will file you a criminal case RA 8484
I stopped believing this lie when I learned that defaulting credit card is not a criminal case after all. It's just a civil case in the Philippines. I also learned that RA 8484 is a criminal case only for those people who defraud credit card companies, people who faked their identity to get approved for a credit card.
So the question of what will happen with my N.B.I clearance is already answered. N.B.I is only handling criminal cases. Yes, I'm cleared and can work both local and abroad if I want to.
I have a travel Ban...I can't work abroad?
So if this is a civil case, what travel ban these people are saying?
Perhaps, another fantasy from my credit card debt collectors. For sure.
Texting me saying I already have a warrant of arrest
Well if I already have a case and I have a warrant of arrest, why they should have to text it? Would it be great to receive it personally?
Come to think of it, if I am really a criminal and I received an SMS like this, would I not start looking for somewhere far from my home to hide? Again, it is a lie.
A police came to my home giving a piece of paper
And that piece of paper is another final demand letter from my collectors...yay! another bluff! I should have immediately report this police to the higher authority or file him a case of extortion and use that piece of paper as a scratch.
Saying they will get my properties
Without a civil case file in court? and without proper hearing and all that? This is a baloney. And what properties will they want to get from me, my old appliances, the pet cage of my dog, my bath towel, what else?
Why these credit card debt collectors doing this to me ?
At first I thought that they are just concern with me not paying my credit cards. But after they begin showing their true color, I stopped believing that these people are people that I should trust my whole life with as a credit card defaulter. Not these people who all they need to get from me is money. All they want is to collect money from me so that they can feed their hungry big stomachs.
How unfair life is for credit card defaulters like me here in the Philippines. But at least now I know that I have nothing to worry about. They can't do anything to me as long as I know my right.
Things I need to ask credit card debt collectors
Why should I have to pay my credit card debts if the bank is no longer interested with it? if the bank keeps on referring me to the collections agency of some unknown law offices? Why should I have to pay if the only thing that they can give me is the demand letter asking me to pay this incredible amount of 40k pesos in just 5 days. Who they are by the way?
If they can't provide me my statement of account that is certified true by the bank, why should I have to pay? If they can't agree with my terms, with my intention to pay only the amount I can? Why should I force myself to agree and sign on their biased agreement.
What if I don't like to pay them really and they said that they will sue me in court? Then I will dare their bluff, tell them to go ahead and sue me. At least in court, the judge is fair and will understand my situation. 100 % that they will win the case, but one thing for sure, it's a pyrrhic victory after all. Harassment and threats ? I worry no more, because I know I can can complain them to Banko Sentral ng Pilipinas ( BSP ) for their violation of Circular 454.
What did I learn from these situation?
A lot and I learn from my mistakes.I learn so many things that makes me tougher and braver. In this life, there are people who will want to scare me and take advantage of my situation. But what should I have to be afraid of if I know my right? I treat this as an experience, a challenge that will make me a better person in the end.
Up until now, I am receiving words from my credit card debt collectors here in the Philippines, but unlike before, I'm already placid this time. Now that I know all the words that come out of their mouths are nothing but just lies.

I received an e-mail & text from Bilkish Philippines. Like what everybody is facing. They'er are threatening me any my wife backhome. I'm currently in Saudi Arabia. They also said, they will deport me back to UAE or Philippines to face my case. How true is that? Can they do that deporting me to UAE or Philippines.

There are good people who will bend over backwards trying to deal with these collectors, who have fallen onhard times and don't have the means to pay...It's a crazy world we live in, and I guess these guys are all the same no matter where you're from! Good write, thanks for sharing.

I appreciate a lot what you shared. Right now, I am experiencing this kind of harassment. We even come to the point that this collector is already threatening me. I am beginning to lose my temper. I am already thinking of going to this law firm and give this ass hole collector a dose of his own medicine. I am already thinking bad things which i know I will regret it. what if they go personally to your workplace and tells you to pay them right at that very moment and would threaten you that they won't leave the building until they get something from you... what is best to be done here? it happened to me!!!

Hi Pretty-in-pink, it's already a violation of your right if they did that to you! you can file them a case. This is happening to me now, an asshole from HSBC keeps on texting me and calling my cell, demanding I pay them a downpayment of 25k for my 75k debt. That's ridiculous! Also, try not to raise your voice o them, and don't loose your temper...these idiots will be put at bay once you know you rights and smack it to their faces! Mabuhay!

I am also worried with my citibank which I issued a PDC last two years ago. I used to pay them within that two year period but this time I could no longer afford to pay because of my health condition and my medicine expenses every month. In short, I have not paid them for 4 months and they are calling me right now to pay them. What will I do>? Can they sue me because of closed current account to which I issued them PDC? Please help me...

Yes.. they can sue you for that.. Issuing PDC's and failing to keep up on it is a criminal case of estafa and can be subject to imprisonment. Whereas, credit card debt is not a problem.. it is only a case filed in a civil way.

Our front desk officer just got a call from a certain "PO3" and was asking for me. I didn't buy the threat for I am aware "he" is fake.
Despite all that I have read about these credit collectors, I was so shaken and was as cold as ice.
PO3 will be here this afternoon to serve my warrant of arrest if I would not call right now a certain mobile no. of a certain lawyer (I refuse to name names because these may just be used in vain by these inconsiderate people).

this is exactly happened to me today.. an PO3 from QCPD called me informing the i have a warrant of arrest to be send the following day in our city . then i asked them what case? she just told me that she dont know. theyre not allowed to opened it coz its sealed. she gave me a landline number and a mobile number , we keep on calling but nobody is answering . she told me that its the number of the Chief of Quezon city police department... ?????????????.. so threatening ..but i just ignored her... dont know what they will do next..

I am also being harassed by hsbc collection agents...through the domingo molaer law services...they went to our house and my mother-in-law was the one present then, they gave them a letter from the firm printed in a half sheet of bond paper...with signature but no printed name below it...and they told me they will be assessing my properties and capacity to pay...and if i fail they will file case against me using RA 8484.... my mother-in-law is so afraid because they told her that i have to pay i don't want to lose my job....this is against the BSP Circular 454....am I right?

i have also experienced that...just last week while i was out, somebody went to our house and left a note, take note...1/8 note stapled with calling card...and it was stated there...my spouse would also be included in the case they are filing!! so ridiculous!! they are doing all means to get money from us...!! which i believe did not really came from the bank!!

This is ignorant statement from credit card collectors. Our judicial system entertains appeals and review cases filed and decided by lower courts. This is why we have Court of Appeals and Supreme Court.

i am so afraid because i have loan from 2 banks i issued post dated cheque but unfortunately after half of the terms im unable to pay them due to my condition they keep sending me some papers about the case that they will file. anyone could help me with this? like for exam 18 months was my term in china trust i already paid half of the terms and due to some circumstance and avoidable expenses of our family i stop paying the loan..when the statement of account the paper saying they will file a case if i will not settle the 110000..but i only loan 48,000 or 55000 including the interest..and the fact i pad half of it suppose to its just like 25,000 is the remaining balance it went up to 110000..they will file criminal case bouncing check etc...

I also encountered this kind of lies from a credit card collectors.. they also told me that the will come for an occular visit to check my assets.. I just ignore them.. they did not come after all.. why? because they know that if they do,they will be 100% in jail now.. and their lawyers and law offices can be filed for disbarment case for extortion and unproper use of their profession to gain profit from people like us.. :) extortion is a human rights violation..:) know your rights! It is the best protection we have against people like them..

I had a credit card with citibank. I intentionally maxed it out and even exceeded the limit. I couldn't keep up with the finance charges that were being assessed every month so one day i decided to put an end to it by spending every centavo that i could get from them and leave them afterwards. and so I did. Its been three months now and they still keep calling me from my mobile phone. I know i need to change my number so I could get rid of them but Im planning to do it after i get rid of another credit card that i now have problems with. citibank approved me of 35K as my limit, and I was able to use about 40K and got charged for the over the limit transaction. More or less the running balance is 55K at this time. This another credit card that I have from another bank has a limit of more than 90K. currently, my outstanding balance is 55k and I can't keep up with the finance charges. I have had it for more than 2 years now. Im planning to do cash advance and get 30K and eventually leave it for good. Can I get a way with it? Im planning to use the 30K to pay off two credit cards that I have and eventually have them closed so i could no longer be tempted to do these things. I know its bad, im just trying to find a way out. currently im having some finance problems and i think this would be the best solution for my problem.

i don't think so,prc has nothing to do with cc debts,i don't think the cc will go that far.your license will only be revoked if you violated the prc law.i don't think there's a law in prc regarding cc debts

i have outstanding bal with cc too. 2 cards both has bal of 160k (per CA computation) i'm offering them pyment of 30k each card, the only amt i was able to find just to settle the acct. Do you think they will accept it later on and give me cert. of account settlement? Can someone give me hope.

i just received a malicious call from citibank today, and again he's threatening me that he will file a case against me if i will not able to pay the minimum amount due. Though i know a lot of friends and colleagues who didnt pay their credit card and havent sued until now, i'm still affected today, because the collector's voice is really fierce. But after reading your blog, i'm now cool about it! thanks for sharing and for all the comments! Great help!

2 police came to our house and said to my mother that I failed to attend arraignment. I did not receive any court letter for such. The 2 police gave a tel number to my mother and told her that I need to call that number. That's the number of certain Atty Hilario. When I tried to call that number, seemed that number is not a valid one.

Actually I received a demand letter from collection agent April of this year for my unpaid credit card Standard Chartered. It has been 5 years that I was not receiving any demand letter from a collection agent and just wondering after many years another collection agent is demanding payment from me again. Before I agreed to pay in installment my unpaid balance of 1500 monthly. I was able to make payments in 6 months and just wondering that even I was paying , still the SOA I received has a penalty and interest in it so I just deicided to stop my payment and said to myself that I would rather settle directly to the bank

me and my husband both have credit cards. unfortunately, we're not able to pay for it since april this year. just last month, somebody called our barangay captain and said that my husband will be arrested for estafa. My husband is in singapore now, upon knowing this, they said that they will deport my husband. is that possible?

Hi I have been receiving non-stop demand letters that I have to be in court on these dates? what will happen if I ignore it.
Also, for my other card I want to settle my account with a specific amount that I could only pay but they said it will not be possible...the next thing they said that they will forward it to the legal department. Now i received an email demanding me to pay the full amount.

Thank you for this blog, i am one of you, i do have debts, its true, they are not interested with your valid reasons why you defaulted in paying, all they are after is for your money, exactly, we should not be afraid of them because they don't own our lives, in fact, they even get richer because of the many bloated interests that we payed when we were still able to repay our credit! until now, i still receive calls but i deal with them peacefully even if they are getting devilish with their unpleasant and unprofessional words like "sa iyo nalang yang perang ibabayad mo, kulang yan, pangdagdag mo nalang yan sa kabaong mo"! and i told him.."okay, thank you po,this means wala na akong utang sa citibank ha? ikaw nalang ang idagdag ku"!

i received a letter coming to the said law firm domingo & molaer law offices... a letter that is not registered mail and not legally notarized...a letter that is demanding me for the payment of the said balance of my credit card ( HSBC) i was affraid because they said that together with my spouse they will constrained us criminally prosecute us for R.A8484...after i read the letter there is another letter asking me me for the special settlement program...until this day i search this law firm then i read all the blogs from dis firm i calm my self and not thinking all this...thank u so much

Thanks for sharing your experience and learnings. I just receive a letter today from a collection agency this is Domingo & Molaer Law Offices. It is said that I have to pay the 35,225.43 on or before January 13, 2012 and if I fail I will be paying the 44,031.79. Where in the letter was delivered January 14, 2012 received by my mother. But the date on the letter was December 27, 2012. My point here is they really delivered the letter on the date that you cannot avail the amicable settlement. Wow! these collection agency are not of help to people like us.

hay grave talaga same here piero iba naman yung case kase ako sobra naman binayad ko yun nga lang napunta sa ibang acct sa hindi pa nakakaalam ang standard chartered mag kaiba yung acct number sa installment at yung credit card mismo,walang transaction yung card ko pero may installment akong binabayaran ngayon hindi ko talaga maintindihan kung nagkautang ako mantalang sobra sobra ang binabayad ko? dahil daw yun sa annual fee, bakit hindi nalang nila itranfer yung sobra sa para mabayaran yung annual fee? ang tanging sagot nila every charges valid, pano kayo yun kasi yung installment at yung credit card ay iisa hindi naman pwedeng magkaroon ng installment kung walang CC BAKIT PAGDATING SA BAYARAN MAGKAIBA?????? SANA MAKARATING ITO SA BSP

i have the same problem with Domingo & Molaer Law Offices. BDO sent me a letter stating that my balance is now down to 20k. Domingo & Molaer Law Offices on the other hand is asking me to pay 27k. now, they are threatening to take me to court. i just ignored them esp. the calls from a certain yvonne from that office.

I have not kept up with payment also due to financial instability with my family for this year and I was persistently harassed and disturbed by these credit card collectors to the point that they even called the barangay captain of our place. I have already sought legal advice with my lawyer and was already enlightened by what he had to say. First, we all get annoyed and humiliated by all these debt collectors and what they are doing. But above all, we need to know why they are even doing this.. The moment we failed to pay our credit cards (what is commonly called a default), the bank flags our accounts as bad debts and they will hand the accounts over to a 3rd party (these are the collection agencies), who buy these accounts from the bank at a much cheaper price than what you have actually owned the bank not including the interests. They will be the ones to take over the endless collection efforts that have annoyed us over time. Whatever we pay from the time these accounts are handed down to the collection agencies, will be a profit of the collection agents, not even of the banks where we owed money. That is why, they are just so professional in harassing us CC debtors. These are all desperate ways of making us pay because this is where they gain profit.. In short, our downfall in debt is their advantage. And still, they wanted to take advantage of us even more. In your case, make sure that the letter you received was really from BDO. You can clarify it from the bank. I heard a term AMNESTY but I don't know and I don't believe if it really exists. It means that the bank should overlook your offense of not being able to pay and should let you pay only of what's due, not including the interests. You must make arrangements with the bank or these collection agency of a scheme of payment, but it should ONLY be according to what YOU CAN AFFORD to pay in your terms, waiving all the interests of your principal amount owned. If they don't agree, then tell them you are not paying anything. But if they do, ask for a written confirmation from them of the payment scheme that you have agreed on and that is when you start paying. Remember, their sole purpose is just to collect money from you. It is better than having none to collect at all. Be fair enough also to make them feel that you have the commitment to pay however small it may be for now, until it is paid up. Assure them also that when you have extra income, you will add a little more to your payments. In fact, you can just haggle with these collection agencies the amount to be paid even lower from the principal amount you owed. You could come up with a good bargain that will be beneficial to both parties as long as you have the willingness to pay. For me, these are just the best way to face your debts and to be freed from these daily disturbances that they cause us. Always agree on fair arrangements for both parties because, totally ignoring these credit card debts will not really make your problem go away. You will be bombarded by these calls day in and day out, to the point of being harassed and threatened. You cannot just ignore all these calls when you know that they will involve other people you know and will also be a cause of your reputation being downgraded, humiliation and even loss of jobs since they will even go to a point of including your boss or work place. You must know that some employers also need a good credit history of their employees. It is when you get an arrangement with your bank/debt collector that you will be freed from all these annoying calls and harassment. Just never forget to put every arrangement into proper and legal writing from both parties so that in your end, you know that every penny you return or pay to them solves your financial problem.

I read your blog here and it's really interesting to follow and since I am also in this kind of dilemma.
I followed your advice and its funny that they even use a reply email with such a law firm. And the payment schemes were not favorable. they gave me 3 options. All of which are burdens and not to my capacity to pay.
Then they replied back and still i have to pay almost 50% of the due amount and they followed my capacity to pay plus 2% interest monthly for 18 months duration. this is way too harsh. I replied to them the email i sent to the bank. Well in fact this people is not directly from the bank and they are still the collectors using a law firm name.

i'm with the same problem because i'm experiencing now a very big financial downfall. I tried talking to this collectors but i can't bear their insults, that's why i never talked to them anymore. There's no use for me to talk to them since they won't listen to me when i ask them to wait for me when i'm already capable of paying.

thanks for the wonderful information...the credit card collectors keep.on harassing my mother that most of the times..she cried to me about how they pushed my mother to pay.and to think that she is still paying only a little of the amount that she was suppose to pay..(at least she's paying instead of not) its a heartbreaking scenario for me as a child...and thank for your info..i will tell my mom that she do not need to worry about the calls or text she is receiving from the collectors. thanks to u!

First of all I would like to thank you for helping us in dealing with this such bad situation. I would like to share my experience regarding the CROCS of BILKISH. They been harassing me for almost three years but I never intimidated with their threats because. I left UAE last 2008 because I was terminated by my company due to recession. Even I have huge amount of loan from the bank I have no choice but to leave the country because I was terminated. I applied for another GCC country and been here for more than 3 years already. I went to vacation every year and sometimes every 6 months but all are normal no one catches me the immigration here in GCC and there in the Philippines (which the BILKISH CROCS use to tell me many times that I'm having hold departure order in GCC countries at the same time in the Philippines - for sure all are lies since I am here and going to have my vacation again soon :)) I use to call me here in my mobile and send me lots of emails na paulit ulit lng sila sa mga sinasabi about my debt. Luckily they already stopped calling to my house and going to my house because I told them I will sue them in court if they did that again...and it works naman...hehe...Sabi ko u have my number and email address so better talk to me...Minsan hdi sila tatawag for long time (let say 3 months) them bigla magpaparamdam ulit at mangungulit na bayadan mo ung loan mo at threatening you again. I just stay calm and told them I owe nothing to you so kung meron man ako utang sa kanila ako magbabayad at hdi sa inyo. Dinadaan ko na lng sa biro pag tumatawag sila...Sabi ko o kamusta na ang mga taga bilkish hdi pa ba kayo nananawa sa kakatawag sa akin..dahil wala naman ako ibabayad sa inyo kahit isang kusing..hehe..kung makapal ang mukha nila e mas makapal ang mukha ko dahil wala naman ako utang sa kanila...I already call the bank regarding my case and what they have told me, only me can clear my liabilities to them...No one can ever give me clearance except the bank and to make this happen I need to go personally to the bank or either one of my relatives or co-maker from UAE will go their and settle it for me. Wiling naman ako magbayad sa kanila pero as of now I have no way, I will not trust any of the BILKISH CROCS to have my money without any assurance that I will clear from the bank...Anytime soon I will be having my next vacation and as always I will enjoy it with my family back their in the Philippines...I'm just waiting for a right time to sue all BILKISH CROCS...i'f they still continue to cross their lines at kapag pinuno na nila ang salop ko...dapat ko na silang kalusin...hehehe...hope you learned from my experience dealing with these collection agencies...

hi! nabasa ko ung blog mo.. and nakampante ako dahil sa nabasa ko. ang babastos kasi talaga ng mga agent collector. hingi lang sana ako ng advise regarding sa pagsettle ng balance ko. kelangan ko bang i-settle un sa bank kesa sa agent?. kasi nagiging hobby na ng agent ung mga paghaharass nila. and hindi na rin nakakatuwa... and pwede ko ba silang i_sue regarding sa mga pinaggagawa nila sakin? thanks

I'm also experiencing harassment from collecting agencies,yesterday they called our bargy. captain in capiz saying that i have a warrant o arrest case estafa..i really worried and my parent get mad because of this.they said they are from camp crame and anytime they will come to my house w/ their sheriff for an ocular inspection , i am really afraid of this,.,.please help me,.,tnx

To Resty: Don't believe with their threats. Those persons that would come from camp crame and sheriffs are the collection agents only. You can file a complaint if someone from the collection agency go to your house. Its a form of harassment already.

I refer to the above matter.
Let me bring this to your knowledge that there was a complaint/ protest which I filed with the Bankard on the method of collection and the behaviour/ attitude of its collecting agents be it collection agencies/ law offices which put further payment of the interests/ additional charges in question pending resolution. I know I have paid the principal amount if payments shall be summed up.
Before you proceed with any further action, let me have the following:
1.) The Service Contract between Bankard and the firm specifying your authority to collect from me and to file a case under small claims and your authority to release from indebtedness upon settlement.
2.) Your Employment Contract with the firm giving you authority to collect from me and to file a case under small claims and your authority to release from indebtedness upon settlement.
3.) The Contract with Bankard that you said I signed showing my signature.
4.) The document supporting my usage of Bankard card showing my signature and the merchants name.
5.) Documents supporting my payments.
6.) A ledger showing all charges, duly authenticated by Bankcard and the Employment Contract with Bankard of the authenticating officer.
7.) The Philippine law mandating the legal interest per annum, the legal penalties and legal additional charges.
8.) A proforma or template of your release of indebtedness document upon settlement.
Both the above unresolved issue and documentary evidence shall determine settlement.

Ito ang nangyari sa'kin. On December 13, 2012 HSBC contacted me to settle the minimum payment for my CC dues in cash at Security Bank by 2:00PM. I was a little late in my payment. Sabi sakin ng kausap ko na "Christine" ang pangalan, "kahit Security bank, sir". I was also able to find out na wala pang charges at the time of the call. So what I did was, I not only paid the minimum amount due, but the full amount in HSBC valle verde branch before 2:00PM para wala nang delay.
Aba, lo and behold, when my statement came, they posted my check payment of P1XXk on December 18 (My receipt says I paid on Dec. 13, 1:45PM) at may kung anu-anong charges pa. Late na raw ako!
So I called them up ng ilang beses about my concern. Sabi nila, wala raw nakatag na may pinag-usapan kami ng collections. Hindi ako magagalit sa kanila o tatawagan sila kung wala kaming pinag-usapan. Sadly, hindi nila inasikaso hanggang sa umabot na sa susunod na cut-off period ng next statement. Sabi nila iimbestigahan nila pero, di nila ginawa. Kaya nang dumating yung next statement ko, mayroon na naman na charges. Hello HSBC?!?! I PAID FOR THE FULL BALANCE! NAKUHA NA NILA PERA KO,tapos ipe-penalize pa nila'ko?!
I wrote their customer service (yung email address sa website) but they weren't of much help. Sinulatan nila ako after mga 20 days (sab nila they will revert to me in 7-10 days) na hindi raw namin pinag-usapan ng kanilang collections noong Dec.13 ang tungkol sa waiving of charges kundi ang probable application of charges upon assessment. HSBC, OBVIOUS BA? Hindi namin talaga pag-uusapan ang charges noong Dec. 13 kasi there were no charges in the first place!! Common Sense! Kaya nga "probable" eh. Ito pa, ang letter na ipinadala nila sa akin ay walang pirma.
Can somebody help me? Do you think I should wait nalang? Pero gusto ko na rin itong matapos. Is it advisable na makipag-usap ako sa isang taga HSBC, I mena from the inside? If so, can anyone give me names?

Tapos pinakausap sa tatay ko ung hepe daw ng CIDG about dito. Tawagan daw itong Atty. Reynaldo Hernandez. Hindi nakatulog ng maayos parents ko dahil sa insidenteng ito. Since I read this blog, nakahinga po ako ng konti. Any advise po about dito? Do i need to contact them about these? 120k pinapasettle nila. thank you po

Guys same din problem ko, may utang na ako sa bank ng more than 300k, di ko na xa kayang bayaran ung monthly bills, umabotna xa sa ganon dahil, ginagamit ko ding pang bayad ung laman ng cc,, paano kung di kona xakyng bayaran??what I'll hppen next?? And wha will I do???

Hi po, I am Che2x from Taguig. Nagloan din ako sa Chinatrust cgro mid ng 2011 un. Per requirement ng bank, I issued check na galing mismo sa knila. Noon wala nmn problema dahil meron akong work at nkakabayad ako on time. Until mid 2012 po ngkaroon ako ng financial issues kaya wasn't able to pay regularly. So ayun, palagi na ako nakakatanggap ng letters at tawag from different law firms / collecting agencies (honestly, di ko na sure kung ano ang difference). Kahit po ganun, deretso parn ako ng pagbabayad ng bank loan minsan delayed nga lng. Dec 2012 till Jan 2013 wala po akong work kaya di ako nkabayad. Nkpagwork ako Feb 2013 lng.
Last month, meron ako nkausap na isang representative daw ng collecting agency (sorry, dahil iba ibang tao ang tumatawag skin at paiba iba sila ng number - di ko na matandaan ang name). Sinabi ko sa knya un current situation ko kung bkt nadedelay un bayad ko sa loan. I even asked her kung pede bayaran staggered un past due and promised not to miss un payment sa mga susunod na months. OO nmn si girl so i thought okay na. KC wala n ako natanggap na twag mula sa knla since nun.
Last week, sa laking gulat ko nkatanggap ako ng text message from 0927-xxxx843. "Since you refuse to cooperate, ATTY PALISOC ordered us to serve ur court order next week. You are being summoned to appear in court. Pls call the said lawyer at (phone #) to hold the issuance of ur notice". Sobrang shock ako kasi akala ko okay un setup na pinagusapan nmn nun kausap ko last month. Nagreply ako saying na "I never refused to cooperate". Dahil ayaw magbgay ng name un katxt ko, I called Atty Palisoc's # tapos nakausap ko cya. Pinababayaran skin the rest of my loan balance pra daw hindi na ako mademanda. Kc papupuntahin na daw sa bahay ko un mga tao nila by Monday, mapapahiya lang daw ako. I told him na kaya nga ako tumawag para mkipag settle. Hindi rin niya alam kung sino un tumawag skin last month at walang kht na anong detail ng settlement nmn tungkol sa partial payment.
Tinaasan ako ng boses, he keeps on interrupting me. Kung ayaw ko daw magbayad eh maghanap na daw ako ng abogado ko sa PAO. Tinapat ko cya na wala akong gnun kalaking halaga. Tapos, sinabi niya na for HUMANITARIAN reasons eh i-settle ko na lng daw un overdue balance ko amounting to 38,000 until March 22. I was trying to ask him to give me pa sana at least 2months pero ayaw nya. Kesyo wala na daw kmi pag uusapan pa. Magharap na lng daw kmi sa korte dhl ESTAFA daw ang kaso ko due to bouncing checks.
So ayun, over the phone pumayag na akong magbayad na lng ng 38,000 kht hindi ko pa sure kung saan ko hahagilapin un pera. He asked me to email them a Promissory letter indicating the promised amount and due date plus two IDs. Dun lang cya naging accommodating at pinasa na ako dun sa secretary daw nya. Binigyan ako ng email address (smurf_cnccsi@yahoo.com) at CP #. Tinanong ko pa nga kung meron sila formal na office email, wala daw.
Ngayon ko lng nabasa itong thread na ito at nkakagaan ng pakiramdam although meron prn tlga akong kaba.
-Paano kung this week eh meron nga sila papuntahin dito sa bahay ko at ipahiya ako pati un family ko?
- Would i just tell them na di ko kaya bayaran un 38,000 until March 22 at ituloy na lang nila un kaso pra dun na lng kami magkita?
-Will I email them un promissory letter na nirequest skin?
-If ever magfile nga sila ng kaso laban skin, need ko ba maghire ng abogado to defend me? wala kc akong pera to pay for legal atty.

even a loan defaulter has rights. defend yourself legally if being harassed by debt collectors. know your rights. pero kung may utang talaga kayo at alam nyo sa sarili nyo na may utang pa kayo na hindi pa nababayaran lahat, dapat naman bayaran. may kasabihan nga na ang utang ay utang. at ang utang ay dapat bayaran. :)

I also experience this,hinaharass aq ng isang law firm..and may ngtxt sakin na sya daw ay secretary of somewhat atty. forgot the name,shes telling me that i should pay my cc that cost around 16k i told her that i have no money bec i have no work at that time,she told me that i pay for it,and if i dont have money i should make utang to a bombay para mabayadan ko yun utang ko,gosh naginit ang ulo q nun,sagot q sa kanya wow miss ganan ba kayo makipagusap sa mga clients nyo na kelangan turuan nyo mangutang sa bombay para mabayaran lang kayo?pity for them they are so desperate!sa eastwest yata yun cc q na un and take note from 4k na cash advance ngboost to 16k??!
